2. 禁止行爲
88DB網站用戶同意不會利用88DB網站內任何部分進行任何以下明令禁止行爲：-

• 所有用戶禁止擾亂或試圖擾亂88DB網站的網絡安全，包括但不局限於取得並不打算供他們取閱的資料，或登錄未授權進入之伺服器或賬戶，試圖探查，掃描或測試系統或網絡之漏洞或在未獲授權之下破壞系統安全或認證措施，試圖以服務幹擾任何用戶、主機或網絡或發送未經請求的電子郵件。擾亂系統或網絡安全之行為可能要負上民事或刑事責任。
• 所有用戶不得利用88DB網站網站進行以下行爲：（1）傳遞、發送或儲存任何觸犯法律或法規之資訊；或（2）以任何形式導致侵犯他人版權、商標、商業秘密或其他知識產權或干預他人私隱權或其他個人權利；或（3）任何帶有誹謗性、淫穢、威脅性、辱駡或帶惡意之行爲。特別是用戶不得列印、下載、複製或抄寫任何他人可識別個人身份之資料（按情況而定）。嚴禁向其他用戶發送任何類型之非應邀資訊。
• 如用戶不具備接受法律文件約束之法律能力，請勿使用88DB網站。
• 用戶不得在網站上發佈任何包含虛假、錯誤、誤導或誹謗內容，或包含任何電腦病毒的資訊。此外，所發佈的廣告不能涉及任何欺騙或假冒商品的資訊。
• 用戶不得濫發訊息，包括但不局限於任何形式之非應邀電子郵件。
• 除用作接受、轉寄、識別、找出和/或回覆廣告或任何內容之外，用戶不得使用任何其他用戶在88DB網站內張貼的內容作其他用途。
• 用戶不得刪除或更改任何他人或個體所張貼之內容或資料。

3. 允許的行爲
a. 特定用途 – 在88DB網站刊登廣告之用戶（「刊登者」）
當刊登者向本公司支付所需服務費後，或當刊登者接受任何免費試用推廣優惠後，刊登者便可依據條款細則及私隱權聲明，在88DB網站內張貼廣告或其他資料。刊登者同意只會利用88DB網站作合法用途。刊登者同意及認可其廣告或其他由刊登者張貼在88DB網站的任何內容（包括任何個人資料）皆可以供觀看者（見下文定義）作爲接受、轉寄、識別、找出和/或回覆廣告或任何內容而取閱。如本公司在認爲可合理達至上述目的情況下，保留修訂任何廣告的權利。
個人刊登者不應把其身份證明文件/護照張貼於廣告內。刊登者同意及認可本公司和/或其附屬公司可運用其個人資料用於供應其他由本公司提供的服務上，及進行本公司及其附屬公司之市場推廣服務及其他特殊活動。

b. 觀看者同意從88DB網站或本公司獲取之任何個人資料僅可用作接受、轉發、識別、找出和/或回覆廣告或其他內容之用。任何與上述目的無關之個人資料應不予理會。觀看者亦同意從88DB網站或本公司獲取之個人資料在上述目的失效或達成後即時及妥善地刪除。

4. 內容特許權
用戶在88DB網站上張貼內容，即表示無條件授予本公司一個非獨家性、全球性、不可撤回及免專利權稅的權力，可行使用戶對該內容之版權、宣傳及數據庫權利（但不包括其他權利）來舉辦、展示及推廣88DB網站上的內容，以及達到私隱權聲明列明之目的。

5. 知識產權
文字、圖像、版面編排、數據庫、圖表、圖片、聲音或音效形式、軟件、商標和其他88DB網站上之其他材料皆屬本公司或其刊登者（按情況而定）之知識產權，受版權法和商標法的保護，未經本公司明確書面許可不得下載或複製。嚴禁重複使用上述任何材料，本公司保留所有權利。

6. 內容
用戶明確瞭解本公司不會預先審查或批准任何張貼於88DB網站上之內容或任何透過88DB網站發送之內容，除本公司有權修改任何部分之影片和/或聲樂之外。在任何情況下，本公司均不會對88DB網站上張貼之內容或透過88DB網站張貼之任何內容負上責任，亦不代表或保證88DB網站上張貼內容之準確性。
任何用戶張貼於88DB網站上之任何材料或詳細資料均可被其他連接到88DB網站之任何網站用戶所觀看，本公司不會為任何用戶或連接的第三方網站上之第三者因任何不正當使用張貼於88DB網站上之任何資料或材料負上責任。所有用戶承認及同意其需單獨地為任何自己張貼的廣告、網頁或包含在內之材料形式、內容及準確性負責。本公司不本公司不會為任何連接到88DB網站之第三方網站上之內容負責，亦不會代表或保證此類第三方網站內容或材料之準確性。
若本公司認爲任何刊登在88DB網站之廣告內容或其刊登者違反任何本協議內之條款，本公司有權獨自決定刪除該廣告而無須作出任何賠償或追索予相關之刊登者。惟當本公司所刪除某廣告之原因與違反協議內之條款無關，本公司可在扣除已刊登時段應收費用後退還餘款（如有）給刊登者。

7. 責任
本公司未必會於任何時間對88DB網站進行監督，但會對此保留法律權利。本公司不保證任何廣告或網頁都能夠達到一定之瀏覽量或被某特定用戶觀看。本公司無論如何不應被視為用戶在88DB網站上之代理，同時無論基於何種原因之下亦不會負責由通過88DB網站所造成之任何直接或間接損失或傷害。本公司竭力為用戶提供高質素之服務，惟不保證88DB網站會在全無錯誤之下運作或88DB網站及其伺服器可避免病毒或其他有害的機制。如果用戶因使用88DB網站或展示其內容而需要運用或更換設備或資料，本公司將不會承擔該等費用。88DB網站及其內容均以「如原狀」的基礎提供而不會有任何種類的保證。在法律允許的最大範圍內，以及不違背上述條款的前提下，本公司對第三方之商業適售性和擁有權，特定目的之實用性或服務、軟體、文字、圖表及88DB網站鏈接之準確性、可靠性、完整性或及時性概不作任何擔保。

8. 自負風險
所有用戶需完全獨自承擔使用88DB網站及其他相連網站可能帶來之風險。所有用戶需負責其溝通方法及負責由他們刊登之材料引致之後果。本公司不代表也不保證任何由用戶刊登之通訊之真實性、準確性或可靠性，亦不支援用戶所表達之觀點。用戶需獨自承擔任何依賴其他用戶張貼之材料可能帶來之風險。本公司保留一切權利在任何時間逐出任何違反本協議或觸犯法例之用戶並禁止其進一步使用88DB網站，本公司同時保留一切權利單獨決定任何材料是否具有辱駡性，不合法、製造混亂或不合適，並於任何時候作出刪除。

9. 其他站點的鏈接
88DB網站可能會連接到第三方網站。這些連結只為方便閣下使用，概不代表本公司支援該第三方網站上之內容。如果任何用戶透過任何鏈接登陸任何第三方網站，其需自行承擔可能存在之風險。

10. 賠償條款
所有用戶同意賠償並使本公司及其管理人員、董事、僱員和代理免受任何由他們經使用88DB網站或違反本協議內的條款，而衍生或導致索賠、行動、要求、損失或傷害。 本公司將及時以通知形式向有關用戶發起此等索賠、起訴或訴訟。

11. 服務的限制
本公司有權限制本服務的使用，包括內容在88DB網站可張貼的時間、內容的大小、電子郵件的訊息或任何可用本服務傳送的其他內容。本公司保留絕對權利可以無須事先通知用戶或無需對用戶作出任何解釋的情況下，修改或刪除88DB網站上張貼之內容或材料。用戶知悉本公司不會因對本服務作出任何改動、暫停或中止而為任何人士負有法律責任。

12. 服務的終止
本公司有權刪除或停用任何帳戶，或阻截任何用戶的電子郵件或IP地址，或終止用戶進入使用本服務，並可即時刪除任何在本服務內之內容而不需要為任何原因作出通告。無論在本服務停用前後或在相關內容在88DB網站上刪除時，本公司概無責任隨時為任何用戶傳送任何張貼在88DB網站之材料或內容。

13. 免責聲明
本公司並不能控制或保證廣告項目之質量、安全性或合法性，張貼項目之真實性或準確性，賣方之銷售能力，買方對商品或服務之支付能力，或交易能否完成。在任何情況下，本公司、其管理人員、董事、僱員或代理概不負責任何用戶由於疏忽或紛爭造成之使用或無法使用88DB網站及他們的內容，而引致或導致之損失、索賠或傷害負責。

14. 有限責任
在不違背上述條款及根據相關法例規定，本公司對任何用戶因使用本服務及88DB網站產生之索償總額上限爲港幣$1,000元。

15. 安全措施
本公司將在合理範圍內全力確保其管理人員、董事、僱員、代理和/或承包商慎重及盡職處理個人用戶遞交之個人資料，此等人士對個人資料之查閲及處理是基於「需要知道」及「需要使用」原則。本公司將在合理範圍內盡力保護個人資料，以避免其被任何未經許可或意外取閲、處理或刪除。

16. 執政的法律及司法管轄權
本文所列載之使用細則，以及由於使用88DB網站所引致或導致之任何爭議或事件均受中華人民共和國香港特別行政區（「香港」）法律管轄和約束。用戶及本公司應服從中華人民共和國香港特別行政區（「香港」）法院之專屬司法管轄。

此中文本只供參考之用。中英文兩種文本之間存在任何差異時，以英文本為准。

88DB.com and its sub-domains (hereinafter collectively referred to as the "Sites") are operated by 88DB Hong Kong Limited (hereinafter referred to as the "Company"). By using the Sites and any other site accessed through the Sites, users acknowledge and agree that the Privacy Statement and the terms and conditions (hereinafter referred to as the "T&C") set out below are binding upon them. If user does not accept either or both of the Privacy Statement and the T&C, please do not use the Sites. The Company may revise the Privacy Statement and the T&C at any time without prior notice. Once posted on the Sites, the amended Privacy Statement and the T&C shall apply to all users. Users are advised to visit this page periodically to review the latest Privacy Statement and the T&C. User’s access to the Sites and the Services (as defined below) will be terminated upon his/her notice to the Company that any change is unacceptable; otherwise the continued use shall constitute acceptance of all changes and they shall be binding upon the user.

1. General Terms

• The Company provides an online platform for individuals, companies and organizations to list the services or products which they offer or want and provides online marketing to users of the Sites (the "Services"). Users may also send their own messages to other users or other third parties through the Sites.
• The Company is not a party of nor is it involved in any actual transaction involving any purchaser, seller or service provider.
• The Company is committed to protect the privacy of the users of the Sites. The Company uses the information of the users according to the terms as described in the Privacy Statement.

2. Prohibited Uses for all users
Users of the Sites agree not to use any of the Sites for any of the following purposes which are expressly prohibited: -

• All users are prohibited from violating or attempting to violate the security of the Sites including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail. Violation of system or network security may result in civil or criminal liability.
• All users shall not use the Sites (1) for transmitting, distributing or storing material in violation of any applicable law or regulation; or (2) in any manner that will infringe the copyright, trademark, trade secrets or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others; or (3) in any manner that is libelous, obscene, threatening, abusive or hateful. In particular, all users shall not print, download, duplicate or otherwise copy any personally identifiable information about other uses (if any). All unsolicited communications of any type to users is strictly prohibited.
• Users shall not use the Sites if they do not have legal capacity to form legally binding contracts.
• Users shall not post any advertisement on the Sites which contains any false, inaccurate, misleading or libelous content or contains any computer virus. Also, the advertisement shall not be fraudulent or involve sale of counterfeit goods.
• Users shall not engage in spamming, including but not limited to any form of emailing that is unsolicited.
• Users shall not use any content posted by other uses on the Sites other than for the purpose of accepting, forwarding, identifying, locating and/or replying advertisement or any content herein.
• Users shall not delete or revise any content or material posted by any other person or entity.

3. Acceptable uses of the Sites
a. Specific Uses - User posting advertisements on the Sites (the "Advertiser")
Upon payment of the service fee to the Company or upon acceptance of any free trial promotion offer, Advertiser shall, subject to the terms and conditions set out below and in the Privacy Statement, be entitled to post any advertisements or other materials on the Sites. Advertiser agrees that he/she/it shall only use the Sites for lawful purposes. Advertiser agrees and consents that his/her/its advertisements or any content posted by him/her/it on the Sites (including any personal data) may be accessed by Viewer (as defined below) for the purpose of accepting, forwarding, identifying, locating and or replying advertisements or any content therein. The Company reserves the right to edit any advertisement as it sees appropriate to achieve the purpose stated herein.
In the event that the Advertiser is an individual, he/she shall not post his/her identification document / passport on the advertisement. Advertiser agrees and consents that the Company and/or its affiliates may use his/her personal data for purposes relating to the provision of services offered by the Company and marketing services and special events of the Company and its affiliates.

b. Specific uses - User viewing the advertisements (the "Viewer")
Viewer agrees that any personal data received from the Sites or the Company shall only be used for the purpose of accepting, forwarding, identifying, locating and or replying advertisements or any content therein. Any personal data which are irrelevant to the above purposes shall be disregarded. Viewer also agrees that any personal data collected from the Sites or the Company shall be promptly and properly deleted when the above purposes have lapsed or been achieved.

4. Content License
By posting content on the Sites, user unconditionally grants the Company a non-exclusive, worldwide, irrevocable, royalty-free right to exercise the copyright, publicity, and database rights (but no other rights) he/she has in the content in order that the Company can host, display and promote the content on the Sites, and carry out the purposes set out in the Privacy Statement and herein.

5. Intellectual Property Rights
The text, images, layout, database, graphics, pictures, sounds or audio formats, software, brands and all other materials on the Sites are the intellectual properties of the Company or Advertisers (as the case may be) which are protected by copyright and trademark laws and may not be downloaded or otherwise duplicated without the express written permission of the Company. Re-use of any of the foregoing is strictly prohibited and the Company reserves all rights.

6. Contents
Any material or details posted on the Sites by any user may be viewed by users of other web sites linked to the Sites and the Company is not responsible for any improper use by any user or third party from linked third party web sites of any data or materials posted on the Sites. All users acknowledge and agree that they are solely responsible for the form, content and accuracy of any advertisement, web page or material contained therein placed by them. The Company is not responsible for the content of any third party web sites linked to the Sites and does not make any representations or warranties regarding the contents or accuracy of materials on such third-party web sites.
The Company shall have the right to remove any advertisement posted on the Sites at its sole discretion without any compensation or recourse to the Advertiser in the event that the relevant Advertiser or the contents of the relevant advertisement is or are in breach of any of the provisions herein. However, in the event that the Company decides to remove an advertisement for any reasons not relating to any breach of the provisions herein, the Company may, after deducting the fees charged for the period that the advertisement has been posted on the Sites, refund the remaining fees (if any) to the Advertiser.

7. Responsibility
The Company may not monitor the Sites at all times but reserves the right to do so. The Company does not warrant that any advertisement or web page will be viewed by any specific number of users or that it will be viewed by any specific user. The Company shall not in anyway be considered an agent of user with respect to any use of the Sites and shall not be responsible in any way for any direct or indirect damage or loss that may arise or result from the use of the Sites, for whatever reason made. WHILST ENDEAVOURING TO PROVIDE A QUALITY SERVICE TO USERS, THE COMPANY DOES NOT WARRANT THAT THE SITES WILL OPERATE ERROR-FREE OR THAT THE SITES AND ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL MECHANISMS. IF USE OF THE SITES OR THEIR CONTENTS RESULT IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA BY ANY USER, THE COMPANY SHALL NOT BE RESPONSIBLE FOR THOSE COSTS. THE SITES AND THEIR CONTENTS ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT PREJUDICE TO THE FOREGOING, ANY IN RESPECT OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, FITNESS FOR PARTICULAR PURPOSE, OR ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF THE CONTENTS, SERVICES, SOFTWARE, TEXT, GRAPHICS AND LINKS OF THE SITES.

8. Own Risk
All USERS SHALL USE THE SITES AND ANY OTHER WEB SITES ACCESSED THROUGH IT, AT ENTIRELY THEIR OWN RISK. ALL users are responsible for their own communications and are responsible for the consequences of their postings. The Company does not represent or guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorses any opinions expressed by users. Any reliance by users on material posted by other users will be at their own risk. The Company reserves the right to expel any user and prevent their further access to the Sites, at any time for breaching this Agreement or violating the law and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate in the Company’s sole discretion.


9. Links to Other Sites
The Sites may contain links to third party web sites. These are provided solely as a convenience to you and not in any way as an endorsement by the Company of the contents on such third-party web sites. If any user accesses any linked third party web sites, he/she does so entirely at their own risk.

10. Indemnity
All users agree to indemnify, and hold harmless the Company, its officers, directors, employees and agents from and against any claims, actions, demands, losses or damages arising from or resulting from their use of the Sites or their breach of the terms of this Agreement. The Company will provide prompt notice of any such claim, suit or proceedings to the relevant user.

11. Limitation of the Service
The Company shall have the right to limit the use of the Services, including the period of time that contents will be posted on the Sites, the size of the contents, email messages or any other contents which are transmitted by the Services. The Company reserves the right, in its sole discretion, to modify or remove any contents or materials posted on the Sites, for any reason, without giving any prior notice or reason to users. Users acknowledge that the Company shall not be liable to any party for any modification, suspension or discontinuance of the Service.

12. Termination of Service
The Company shall have the right to delete or deactivate any account, or block the email or IP address of any user, or terminate the access of users to the Services, and remove any content within the Services immediately without notice for any reason. The Company shall have no obligation to deliver any material or content posted on the Sites to any user at any time, both before or after cessation of the Services or upon removal of the related contents from the Sites.

13. Disclaimer
The Company does not have control over and does not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the ability of sellers to sell items, the ability of the purchasers to pay for the items or services, or that a transaction will be completed. IN ANY EVENT, THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS SHALL NOT BE LIABLE IN ANY EVENT FOR ANY LOSSES, CLAIMS OR DAMAGES SUFFERED BY ANY USER WHATSOEVER AND HOWSOEVER ARISING OR RESULTING FROM HIS/HER USE OR INABILITY TO USE THE SITES AND THEIR CONTENTS, INCLUDING NEGLIGENCE AND DISPUTES BETWEEN ANY PARTIES.

14. Limitation of Liability
Without prejudice to the above and subject to the applicable laws, the aggregate liability by the Company to any user for all claims arising from their use of the Services and the Sites shall be limited to the amount of HK$1,000.
15. Security Measures
The Company will use its reasonable endeavors to ensure that its officers, directors, employees, agents and/or contractors will exercise their prudence and due diligence in handling the personal data submitted by users, and the access to and processing of the personal data by such persons is on a "need-to-know" and "need-to-use" basis. The Company will use its reasonable endeavors to protect the personal data against any unauthorized or accidental access, processing or erasure of the personal data.

16. Governing Law and Jurisdiction
The terms and conditions as set out herein and any dispute or matter arising from or incidental to the use of the Sites shall be governed by and construed in accordance with the laws of The Hong Kong Special Administrative Region of the People’s Republic of China ("Hong Kong"). Both users and the Company shall submit to the exclusive jurisdiction of the courts of The Hong Kong Special Administrative Region of the People’s Republic of China ("Hong Kong").
